1. Introduction
Welcome to the Victory Tractor Implements Affiliate Program. This program is designed to help you earn commissions by promoting our products using a unique affiliate link assigned to you upon registration. By participating in our affiliate program, you agree to abide by these Terms and Conditions.
2. Affiliate Obligations and Conduct
2.1 Account Setup: To join our affiliate program, you must complete a registration form and be approved. Only accurate and up-to-date information must be provided.
2.2 Use of Links: You will be provided with a unique tracking link. This link must be used for promoting Victory Tractor Implements products to ensure proper tracking of referrals.
2.3 Promotional Methods: You are encouraged to promote our products in a manner that is respectful and honest. The use of spam or other unethical promotional methods is strictly prohibited and may result in termination of your affiliate account.
3. Commission and Payment
3.1 Earning Commissions: Commissions are earned on sales generated through your unique tracking link, at rates specified within your affiliate dashboard. Commissions are paid based on the purchased price of the item(s) and do not include commissions on shipping charges or sales tax.
3.2 Payment Schedule: Commissions are paid between the 1st – 5th of each month, provided that your earnings have reached a minimum threshold of $100. Payments below this threshold will roll over to the next payment period. Commissions on eligible purchases will accrue no sooner than 45 days after the purchase date.
3.3 Payment Method: Payments will be made through PayPal. Affiliate must have a valid PayPal account to receive payments
3.4 Tax Responsibilities: As an affiliate, you are responsible for all tax obligations arising from your earnings.
4. Intellectual Property
4.1 Brand Usage: You are permitted to use our trademarks and branded materials provided in the affiliate toolkit for the purpose of promoting our products.
4.2 Ownership of Content: All promotional materials provided by Victory Tractor Implements remain our intellectual property and must not be altered without permission.
5. Termination and Consequences
5.1 Grounds for Termination: Your affiliate account may be terminated for misconduct, including but not limited to fraud, spam, or misrepresentation of our products.
5.2 Consequences of Termination: Upon termination, all unpaid commissions will be forfeited.
6. Limitation of Liability
Victory Tractor Implements will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate negligence, cancelled customer orders, returned items, or any other circumstances resulting in termination of sale.
7. Modifications to the Terms
We reserve the right to modify these terms at any time. Changes will be posted on our website and communicated to you via email.
8. Legal Considerations
8.1 Governing Law: These terms shall be governed by the laws of the State of California.
8.2 Dispute Resolution: Any disputes will be handled in the state or federal courts of California.
9. Miscellaneous
9.1 Entire Agreement: These Terms constitute the entire agreement between you and Victory Tractor Implements.
